Affiliates are not permitted to wager using an Affiliate account. If an Affiliate would like to play on the Website, the Affiliate must set up a separate player account. Any such personal player account must not be directly tagged to the Affiliate's account.
3. TERM AND TERMINATION3.1 The term of an Affiliate's participation in the Programme will begin upon Pure Casino's written confirmation of acceptance into the Programme. 3.2 Either Pure Casino (or any third party service provider managing the Programme on Pure Casino's behalf) or Affiliate may terminate this Agreement and Affiliate's participation in the Programme at any time, with or without cause, by giving the other party at least 10 days' prior written notice of termination. Such notice is to be sent to Pure Casino by email to affiliates@purecasino.ca (Attention: Affiliate Manager), or to the Affiliate by email to the address set out in the Application (or such other email address that Pure Casino may have on file for the Affiliate). 3.3 Pure Casino has the right to terminate this Agreement without prior notice if: (a) in Pure Casino's sole and absolute opinion, the Affiliate does anything to bring the reputation of Pure Casino, any third party service provider managing the Programme on behalf of Pure Casino, or any Brand into disrepute; (b) an Affiliate Player is banned from playing at the Pure Casino Website for any reason; (c) Pure Casino determines at any time, in its sole and absolute discretion, that the Affiliate or the Affiliate Website is unsuitable for the Programme; (d) the Affiliate breaches any terms or conditions of this Agreement or any Applicable Law; (e) the Affiliate's conduct endangers any gaming licences held by Pure Casino, the AGLC, AiGC, or their affiliates; or (f) the Affiliate is the subject of any adverse finding, investigation, or enforcement action by the AGLC, AiGC, or any other gaming regulator. 3.4 Pure Casino reserves the right, at its sole discretion, to close Affiliate accounts due to any of the following: (a) did not pass screening; (b) no response to screening verification after one month; (c) duplicate account; (d) failure to provide correct account information; or (e) fraudulent account. Any balance remaining on an account closed for these reasons will be forfeited upon closure. 3.5 If this Agreement is terminated pursuant to Clause 3.2, the Affiliate will be entitled to any unpaid Commissions earned on or before the date of termination. For the avoidance of doubt, no Commissions arising after the date of termination will be paid. 3.6 If this Agreement is terminated pursuant to Clause 3.3, the Affiliate shall not be entitled to any unpaid Commissions earned on or before the date of termination.
4. Pure Casino may withhold any final payments pursuant to Clause 3.5 for a reasonable time to ensure that the correct amount is paid. 4.3 If Pure Casino continues to permit activity from the Affiliate's customers after the date of termination, this does not constitute a continuation or renewal of this Agreement or a waiver of termination. 4.4 The Affiliate will return to Pure Casino any confidential information and all copies thereof in their possession, custody and control relating to Pure Casino and the Brand. The Affiliate will cease all use of any trade names, trademarks, service marks, logos and other designations of Pure Casino. 4.5 The Affiliate and Pure Casino will be released from all obligations and liabilities arising after the date of termination, except with respect to those obligations that by their nature survive termination. The minimum payout amount is as follows:
6.10 There shall be no maximum payout, unless otherwise agreed in writing. 6.11 Every Affiliate will participate in the standard Commission structure unless a different structure has been agreed upon in writing between the Affiliate and Pure Casino.

MISCELLANEOUS10.1 This Agreement constitutes the whole agreement between an Affiliate and Pure Casino in relation to its subject matter. 10.2 An Affiliate agrees that if Pure Casino does not exercise or enforce any legal right or remedy which is contained in the Agreement, this will not be taken to be a formal waiver of Pure Casino's rights, and those rights or remedies will still be available to Pure Casino. 10.3 An Affiliate may not assign this Agreement, by operation of law or otherwise, without prior written consent of Pure Casino. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against both parties and their respective successors and assigns. Except insofar as these Terms expressly provide that a third party may in their own right enforce a term of these Terms, a person who is not a party to these Terms has no right to rely upon or enforce any term of these Terms. 10.9 Limitation of Liability. Pure Casino's obligations under these Terms do not constitute personal obligations of the owners, directors, officers, agents, employees, vendors or suppliers of Pure Casino. In no event will Pure Casino be liable for any indirect, special, incidental, consequential or punitive loss, injury or damage of any kind (regardless of whether Pure Casino has been advised of the possibility of such loss) including any loss of business, revenue, profits, goodwill or data arising in connection with any termination of these Terms or an Affiliate's participation in the Programme. Pure Casino's aggregate liability arising under these Terms, whether in contract, tort (including negligence) or for breach of statutory duty or otherwise, shall not exceed the revenues generated and payable to the Affiliate in relation to the Pure Casino Website that the dispute relates to over the previous 12 months at the time the event giving rise to the liability arose.
